The petition of Magdalen Tyringham, Derbyshire, 15 July 1649

To the right Hon[oura]ble the Kn[igh]ts, Cittizens & Burgesses in Parliament assembled

The humble Peticon of Dame Magdelen Tyringham Widdow & Relict of S[i]r Arthur Tyringham Kn[igh]t one of the Priuie Councellors for the Kingdome of Ireland late deceased.

Most humbly Sheweth.

That y[ou]r Pet[itione]r longe before & at the beginninge of ye now Rebellion in Ireland, was possessed to her owne vse & her Sonne Nicho[las] Bagenall Esq[uire] of ye seuerall mann[o]rs, Lo[rdshi]ps  Townes of Newery, Carlingford, Cooley, Omeath, Greencastle, the Lo[rdshi]p of Mourne, & other lands in ye Province of Vlster in ye sayd Kindome, of a very good yearly vallew, from her first husband, Arthur Bagenall Esq[uir]e deceased, sonne & heire vnto S[i]r Henry Bagenall, & Granchild vnto S[i]r Nichol[as] Bagenall both Marshalls of Ireland, & ye later slayne on ye feild by Tyrone in Q[ueen] El[izabeth’s] dayes, when hee was Lo[rd] Genne[era]ll to whom ye later those Lo[rdshi]ps & lands, w[i]th ye gouernment of those partes, were granted by K[ing] H[enry] y[e] 8th for theire great seruice, in reducing and planting those places, for w[hi]ch purpose, they sould they sould [sic.] a great Estate {illegible}ffordsh[i]re & expended of, all ye profits of theire liuing in Wales, & euer since these gouernments, have been granted to ye proprieto[rshi]ps of those lands, as to theire vse, & their heires, in time of their minority, vntil the beginning of the now Rebellion in Ireland.

That S[i]r Arthur Tyringham her last husband, at ye time the sayd Rebellion began, haueinge gouernment of Newry, Carlingford, Dundalke, Greencastle & other partes w[hi]ch weare vnder ye com[m]and of S[i]r Nicholas & S[i]r Henry Bagenall, & when hee was reddy to come for England, stayed there, & by commission from ye state raysed a Regim[en]t of foote at his own cost & procured money w[i]thout any aduance money, from ye state & by Gods mercy, w[i]th part of ye sayd Regim[en]t the last first of Nouemb[e]r 1641 vallorously performed a great & very remarkable seruice, in ye battle at Lisneygaruey, against many thousands of Rebells Commanded by S[i]r Phileme O Neale S[i]r Con[nor] Maginnes Col[one]l Bearne Col[one]l Plunckett MacCartan & many more of the most remarkable rebells of all Vlster, by w[hi]ch seruice, hee not only obtained a great & glorious victory, but vnder God, deliuered thereby that Province, from a great hazard of being lost, & w[i]th extreame labor & toyle of ye seruice, hee fell sicke, & shortly after dyed.

That shee hath not out of all her Estate there, for these 7 yeares March last, receiued one pennyworth of profit. The first of ye 7 yeares, the Rebells possessed ye same, burned ye castle of Carlingford & Greencastle, & ye whole towne of Carlingford. & in May: 1642: her estate was deliuered into ye Parliam[en]ts power, the Scottish & English Armie, who tooke all the forfeitures & profits, w[hi]ch weare very great, & though by letters pattents granted to y[ou]r peti[tione]rs first husbands ancestors, & their heires, yet ye same hath been & is in the possession of the protestant party, who have kept from her, ye whole rents & profits thereof & committed great spoyle & wast, in pulling downe ye howses of her towne of Newery & selling & shipping away ye roofes & flowers thereof.

In regard of her husbands life w[hi]ch hee lost, w[i]th the services hee did at the battel at Lisnergaruey, w[i]th part of ye Regim[en]t w[hi]ch hee raysed from by commission from ye state, in raysing and supporting that Regim[en]t & other ways hee hath attached vpon himselfe very great debts, & sums of mony w[hi]ch yo[u]r peti[tione]r could shee have received ye profits of her estate in ye Province of Ulster, would herselfe have discharged, till the Hon[oura]bl[e] howse had taken his seruices into consideration & his entertainment payd, but shee not being able, for the reasons aforesaid, to pay those great debts, which shee is much for [illegible]

Your peti[ti]o[ne]r most humbly desires you will please to take into serious consideration the great loss of her deseruing husband, & how much shee is preiudiced by not receauing ye profits of her own estate since May 1642 that all her Estate came to ye Parli[a]m[en]ts power, you will out of yo[u]r goodnes please to giue her such present satisfaction as you shall in yo[u]r wisdoms thinke fitt, & for ye residue of ye sayd time that her Estate hath been in ye power of ye Rebells, & her losses thereby, you will please to consider her for the same, & for the destruction & burning of her Castles of Carlingford & Greencastle & ye Towne of Carlingford, & other wasts & spoyles donne by ye Rebells, you will please to giue her satisfaction out of the Rebells lands, & to order that ye posession of her estate, may w[i]thout farther delay, bee delieured to her & her son, & that those that haue & doe possess themselues of her Estate & haue or doe make spoyle thereof may be made answerable therefore, & to be pleased that for payment of those debts, shee may receaue such sums of mony as are dew vnto her sayd husband for his entertaynment, & for raysing his Regim[en]t according as ye Hon[oura]ble howse hath thought fitt, & been pleased to allow others, & for mayntayning thereof till the time of his death, as alsoe, what is due to him for his ould Parliam[en]t company there.

Resolued &ct the sayd petition bee referred to ye Committye for Irish affayres in the starr chamber, to consider thereof & state the busines & present their opinions to the howse.
