Melmerby was at these sessions indicted and convicted as being an incorrigible rogue and had received punishment by being burnt in the left shoulder. It was therefore ordered by the court that he be committed to the gaol at York Castle, there to be kept in safe custody until he be transported to some of the English plantations beyond the seas according to the statute.
